The legal relationship between the dentist and the patient is of a private law nature. In the case of treatment at the expense of health, disability and accident insurances, the relevant statutory provisions of the respective insurance also apply.
Dental documentation, in particular patient files, examination findings and other records, are the property of CITYDENTAL. It will be kept by CITYDENTAL for the patient and made available exclusively to the dentists and assistants treating patients on its premises and used for invoicing, debt collection (Zaala AG, Creditreform) and patient information. The X-ray images are the property of the patient, provided they have been paid for. On request, copies of the patient file and the original X-ray images will be sent exclusively to the patient with regard to data protection. The practice's retention period for patient files, including x-rays, is 20 years, after which dormant documents are destroyed in accordance with data protection regulations. Data of patients who book appointments online are uploaded to a protected server of Martin Engineering AG, Nänikon.
Agreed dental or dental hygiene treatment appointments are fixed appointments. The treatment times as well as the staff and infrastructure are kept free for the respective patient alone. If the patient is unable to attend the appointment, he/she must inform the practice by telephone at least 48 hours, i.e. at least 2 working days before the agreed appointment, that he/she is unable to attend. Forgotten appointments or appointments that are not cancelled in good time will be invoiced in accordance with the applicable tariff, sections 4014/4013 or 4.0140/4.0130 (missed session per 15 minutes at the dentist or dental hygienist), if they cannot be reallocated. Furthermore, the practice cannot assume the individual cancellation risk of sudden illness or professional incapacity for all patients on a flat-rate basis. On presentation of a valid medical certificate, the costs for the missed session can usually be cancelled. Appointment cancellations outside practice opening hours can be sent in writingvia the contact form on our website citydental.ch and by email to info@citydental.ch up to 48 hours before the appointment.
Invoices must be paid in full within 20 days of receipt. In the event of late payment, CHF 30 per reminder (2 reminders) will be charged after a free payment reminder. If payment is still not made, the case will be handed over to Creditreform or ZAALA. The fee will then be an additional CHF 150 and data will be forwarded to the relevant authorities, insurance companies and courts.
Monthly instalments can be agreed, provided they are expressly requested before the start of treatment. An interest rate of 9.9% is charged on agreed instalments. In the event of late payment by instalments, the full amount is due immediately.
According to the case law of the Federal Supreme Court, dental work constitutes a contract in the legal sense in accordance with Art. 394 ff of the Swiss Code of Obligations. Under contract law, the agent (dentist) is liable to his client (patient) for the faithful and careful fulfilment of the contract. This means that the dentist's work must comply with the generally known and recognised rules of dentistry. This also means that the success of the treatment cannot be guaranteed. This rule also applies in the area of dental care under social insurance law (e.g. UVG or KVG) and even if the insurance company issues instructions for the patient's treatment. Malpractice is deemed to have occurred if the dentist clearly breaches his duty of care. This is the case if he neglects valid dental knowledge or disregards recognised rules of dental science. In unclear cases, such as material fatigue or premature ageing of the restoration, the practice management will decide on a case-by-case basis whether to replace the restoration as a gesture of goodwill.
Photographs, X-rays and video recordings may be used anonymously for training and advertising purposes. If this is not desired, the box "I do not agree to the use of my recordings" can be ticked on the registration form.
